Rules for Use of Urban Passenger Land Transport

RULES FOR USE OF URBAN PUBLIC LAND TRANSPORT (TRAMS, TROLLEYBUSES AND BUSES) IN MOSCOW

Approved by the Decree of the Government of Moscow No. 797-PP dated September 02, 2008 (as amended by Decrees of the Government of Moscow No. 633-PP dated November 20, 2012, No. 55-PP dated February 18, 2014, No. 483-PP dated August 27, 2014, and No. 880-PP dated December 15, 2015)

1. General

1.1. These Rules for Use of Urban Public Land Transport (Trams, Trolleybuses and Buses) in Moscow (hereinafter the “Rules”) have been developed in accordance with the Civil Code of the Russian Federation, the Code of Administrative Offences of the Russian Federation, Law of the Russian Federation No. 2300-1 dated February 7, 1992 “On Protection of Consumer Rights”, Federal Law No. 259-FZ dated November 8, 2007 “Charter of Road Transport and Urban Land Electric Transport”, Decree of the Council of Ministers - the Government of the Russian Federation No. 1090 dated October 23, 1993 “On Traffic Rules” (hereinafter the “Traffic Rules”), and Law of the City of Moscow No. 45 dated November 21, 2007 “Code of Administrative Offences of the City of Moscow”.

1.2. These Rules set out the procedure for the use of urban public land transport (trams, trolleybuses and buses) equipped with automated fare control systems that carries passengers using tickets at the rates established by the Government of Moscow. These Rules are binding on transport companies that provide such transportation services and on passengers.

1.4. These Rules must be available in passenger compartments of urban public land transport vehicles (trams, trolleybuses and buses).

1.5. The operation schedule of urban public land transport in Moscow is established by the Department of Transport and Road Infrastructure Development of Moscow. Information about operation schedules of urban public land transport shall be available at stops along the lines and on the official website of the Department of Transport and Road Infrastructure Development of Moscow.

2. Passenger transport companies (carriers) shall:

2.1. Provide transportation of passengers in all categories, including, without limitation, persons with disabilities, to the point of destination according to the established route.

2.2. Ensure that stencils with information about stop names, line numbers and schedule, indicating the lines’ terminal stops, are available at stops, and that people with impaired vision and hearing have access to this information.

2.3. Meet the service intervals established for lines of urban public land transport vehicles (trams, trolleybuses and buses).

2.4. In case of a scheduled line route change or closure, inform the public through the media or by placing announcements at stops.

2.5. In case of operational change in a route, inform the public accordingly by placing announcements at stops and by providing vehicles with information signage.

2.6. Ensure that vehicle compartments are in proper technical and sanitary condition and the vehicles have appropriate equipment and interior and exterior design in accordance with the applicable requirements before they depart to serve the lines.

2.7. Ensure safe transportation of passengers. The carrier will be liable for failure to comply with the terms of transportation set out in relevant regulations and legal acts of the Russian Federation and the City of Moscow in accordance with the current laws.

3. Duties of drivers of public urban land transport (trams, trolleybuses and buses)

3.1. The driver shall:

3.1.1. Upon having detected, or been informed by passengers of, any objects likely to pose a danger to life and health, or a burning smell, smoke, fire or electric current impact in the compartment of the vehicle, act in accordance with the applicable instructions.

3.1.2. Strictly comply with the Traffic Rules.

3.1.3. Ensure that passengers are transported in strict compliance with the requirements for vehicle operation, road safety and safety of passenger traffic.

3.1.4. Make sure that a tram, trolleybus or bus departs from a stop after the boarding and alighting of passengers is complete and only with the doors closed.

3.1.5. Inform passengers, including passengers with impaired vision and hearing, of the name of each current and next stop, and provide other information using a recorder and special facilities.

3.1.6. In the event the warning devices are inoperable or unavailable, or the route is changed on an operational basis, make announcements using a microphone throughout the route until the warning devices are repaired or installed, or until returned to the usual route.

3.1.7. Sell tickets at stops only.

3.1.8. Issue tickets to passengers upon receipt of the fare payment according to the established rate.

3.1.9. Limit boarding of passengers subject to the occupancy of the tram, trolleybus or bus compartment after notifying the passengers that the boarding is completed.

3.1.11. Comply with the established line route and the service schedule of urban public passenger transport.

3.1.12. Ensure that passengers board and alight at equipped stops provided by the route plan, save in case of emergency.

3.1.13. When driving on an established route of public urban transport, ensure that the vehicle is provided with information signage indicating the route number and the names of the terminal stops and main intermediate stops.

3.1.14. Ensure safe boarding and alighting, including through the second door, and comfortable traveling conditions for wheelchair users, people with locomotor disabilities, and people with impaired vision and hearing.

3.2. Other duties of the driver shall be defined in his/her job description.

4. Boarding and alighting

4.1. Passengers are only allowed to board and alight a tram, trolleybus or bus at stops, after the vehicle is fully stopped.

4.2. Passengers shall take it in turns to board and alight a tram, trolleybus or bus.

4.3. A tram, trolleybus or bus equipped with turnstiles shall be boarded using the front door. Where no turnstiles are provided, passengers may board using any door of the vehicle and pay the fare using the ticket validator near the respective door.

4.4. A tram, trolleybus or bus equipped with turnstiles may be exited using any door, except for the front door. If not provided with turnstiles, a tram, trolleybus or bus may be exited using any door. To exit, passengers should give a signal to the driver by pressing a bell button.

4.5. Passengers with baby carriages, people with locomotor disabilities, visually impaired people with a guide dog or a white cane are allowed to board a tram, trolley or bus equipped with turnstiles using the second door after the alighting passengers have alighted.

4.6. Wheelchair users are allowed to board a tram, trolleybus or bus equipped with facilities for disabled persons using the second door after the alighting passengers have alighted.

4.7. When boarding and alighting a tram, trolleybus or bus, passengers must hold on to the handrail in order to avoid injury.

4.8. Passengers with a bicycle are allowed to board a tram, trolleybus or bus, if the bicycle can be accommodated in the passenger standing area thereof. Passengers with a bicycle are allowed to board a tram, trolleybus or bus equipped with turnstiles using the second door after the alighting passengers have alighted.

5. Payment of fare and hand luggage charges

5.1. The fare shall be paid at the current rates upon boarding a tram, trolleybus or bus by validating a ticket or debiting a universal electronic card (UEC) for the fare amount (a trip) using ticket validators. Magnetic stripe tickets shall be passed through a ticket validator. Tickets without a magnetic stripe (hereinafter “contactless tickets”) and UECs shall be placed against the reader of a ticket validator. It is recommended not to keep tickets with electromagnetic radiation sources in places with high humidity and high temperatures and to protect them from chemical and mechanical exposures. When boarding a tram, trolleybus or bus, passengers entitled to free fares shall register the trip by placing the Moscow Social Card (MSC), Moscow Region Social Card (MRSC) or UEC against the reader of a ticket validator. When boarding a tram, trolleybus or bus equipped with turnstiles using the second door, passengers of the categories referred to sections 4.5, 4.6 and 4.8 hereof shall pay the fare (register a trip) using the ticket validator near the second door or, if not available, using the ticket validator near the front door.

5.1(1). To pay the fare (register a trip), a contactless ticket, MSC, MRSC or UEC should be placed in parallel with and attached against the reader of a ticket reader and held in this position for at least 2 seconds.

5.1(2). The payment of fare (trip registration) is confirmed by green light indication on the turnstile and/or ticket validator and/or by a relevant message in the information line on the ticket validator display.

5.2. Payment for hand luggage (with a sum of length, width and height exceeding 120 cm) shall be made by validating a ticket for hand luggage other than a fare ticket. A passenger carrying hand luggage shall first validate a hand luggage ticket and then a fare ticket using a ticket validator. Tickets for individuals entitled to free or reduced fares do not entitle them to carry hand luggage for free.

5.3. Fare tickets for trams, trolleybuses and buses shall be purchased in designated offices selling tickets for public urban passenger transport, from drivers, conductors, distributors and at sales offices of organizations that have ticket selling contracts.

5.4. A ticket is deemed valid only if it is designed for using public urban land transport in Moscow.

5.5. Invalid tickets include the following:

5.5.1. Expired tickets.

5.5.2. Tickets for a limited number of trips with all the trips used.

5.5.3. MSCs, MRSCs, UECs and student discount tickets illegally used on public urban land passenger transport, or in a suburban service bus with unlimited trips (for student discount tickets).

5.5.4. Tickets on a stop list. Stop list is a list of numbers of series of tickets, MSCs, MRSCs, UECs and student discount tickets suspended by the carrier based on the information about illegal issue or withdrawal thereof received from a competent government authority or subordinate organizations (state institutions and unitary enterprises) of government authorities.

5.5.5. Defective tickets are tickets with a damaged magnetic stripe or record on the magnetic stripe, mechanically damaged tickets, and unreadable contactless tickets. A defective ticket will not be accepted by a ticket validator.

5.6. Defective tickets shall be exchanged at designated offices selling tickets for public urban passenger transport in accordance with the applicable instruction for ticket exchange approved by the transport company. Tickets damaged externally, including by mechanical, thermal, chemical or other exposures, will not be replaced. A ticket with unlimited trips and the “Wallet” ticket (entitling the holder to travel within the amount paid) that is externally damaged by mechanical, thermal, chemical or other exposures will be restored by the transport company against payment for the cost of manufacturing (with the paid period of validity being restored) after it is delivered by the passenger at a designated office selling tickets for public urban passenger transport.

Lost tickets (including contactless tickets) will not be restored or blocked.

5.7. In case of failure of an MSC or other document entitling the holder for free or reduced fares that is not on a stop list on a tram, trolleybus or bus equipped with turnstiles, the driver shall allow the passenger to board the vehicle using the second door.

6. Travel procedure

6.1. The list of categories of individuals entitled to free or reduced fares on public urban land transport (trams, trolleybuses and buses) shall be defined in accordance with the laws of the Russian Federation and the City of Moscow and other legal regulations of the Russian Federation and the City of Moscow.

6.2. The passenger shall:

6.2.1. Pay the fare (register a trip) in the manner set out in section 5.1 hereof. One validation of a ticket entitles the passenger to a single one-way trip.

6.2.1(1). Where no turnstiles are provided, make sure that payment of fare (ticket registration) using a ticket validator has been completed as provided in section 5.1(2) hereof.

6.2.2. Keep the tickets validated by a ticket validator until the end of the trip.

6.2.3. Carry documents entitling the passenger to free or reduced fares.

6.2.4. Present for inspection (hand over) to public urban land transport fare inspectors and conductors all types of tickets and documents entitling to free or reduced fares. In Moscow, public urban land transport fare inspectors are officials authorized by the carrier (the carrier’s inspectors) and officials of GKU “Organizator Perevozok” (inspectors of GKU “Organizator Perevozok”).

6.2.5. In the event the carrier’s inspectors discover that a passenger failed to pay the fare or the hand luggage charge payable under section 5.2 hereof, or that the ticket presented to confirm payment of the fare and/or hand luggage charge is invalid, the passenger shall pay the fare and/or the hand luggage charge by purchasing a ticket from the carrier’s inspectors at the established price and validate the ticket using a ticket validator. If the passenger refuses to present a travel document (ticket) and/or to pay the fare and/or hand luggage charge to the carrier’s inspector, the passenger must leave the tram, trolleybus or bus at the nearest next stop.

6.2.6. In order to avoid injury, hold on to the handrail when the tram, trolleybus or bus is in motion.

6.2.7. The front seats in the compartment labeled with specific words or symbols are designated for disabled persons, elderly people, passengers with children and pregnant women. Other passengers sitting on these seats must vacate them for the above listed persons.

6.2.8. Comply with public order when on public urban land transport.

6.2.9. Upon arrival at the terminal stop of the route, vacate the tram, trolleybus or bus.

6.2.10. When purchasing a ticket from the driver, prepare cash in advance, not impede or complicate the movement of other passengers.

6.3. The passenger shall have the right to:

6.3.1. Carry with him for free:

6.3.1.1. Children aged under 7 years.

6.3.1.2. A baby carriage.

6.3.1.3. A children’s sled.

6.3.1.4. One piece of hand luggage with a sum of three dimensions (height, length and width) not exceeding 120 cm.

6.3.1.5. A pair of skis in a bag or other sports equipment in a bag.

6.3.1.6. Animals and birds in cages with a closed bottom (baskets, boxes, containers, etc.), provided the size of the cage (basket, box, container, etc.) does not exceed the hand luggage dimensions as set out in section 6.3.1.4 hereof.

6.3.1.7. A musical instrument in a case or bag.

6.3.1.8. One bicycle in the passenger standing area of a tram, trolleybus or bus, provided no inconvenience is caused to other passengers (the passenger must hold the bicycle when the vehicle is in motion in order to prevent it from spontaneous movement in the compartment and comply with the requirements set out in paragraph 6.2.6 hereof).

6.3.2. Continue a trip with a ticket validated in a tram, trolleybus or bus that is taken off line due to a malfunction by taking the next following tram, trolleybus or bus without extra charge.

6.3.3. If a ticket is discovered to be faulty, apply to a designated office selling tickets for public urban passenger transport to exchange it.

6.3.4. Carry domestic animals, including guide dogs of visually impaired people, provided no inconvenience is caused to other passengers (dogs must wear a muzzle and be kept on a tight leash).

6.4. Passengers are prohibited to do the following:

6.4.1. Travel in a tram, trolleybus or bus without having paid the fare.

6.4.2. Travel while wearing dirty clothes, and carry malodorous and hazardous (flammable, explosive, toxic, corrosive, etc.) substances, cold steel and firearms without covers and packages, and items (objects) that may contaminate the vehicle or passengers’ clothes.

6.4.3. Smoke in the passenger compartment.

6.4.4. Enter the vehicle while being under the influence of mind-altering substances, consume alcohol, alcohol-containing products, narcotic drugs or psychotropic substances.

6.4.5. Damage the vehicles and equipment installed in the passenger compartment.

6.4.6. Actuate, without permission, door opening mechanisms, fire-fighting equipment, escape hatch levers, emergency exits rings or other equipment, and prevent the closing or opening of doors, unless required for the prevention of accidents posing a threat to life and health of passengers.

6.4.7. Lean out of windows, put hand luggage on the seats, and soil the seats.

6.4.8. Distract the driver and talk to him while driving.

6.4.9. Use invalid tickets for travelling.

6.4.10. Use a discount or regular ticket issued to another person.

6.4.11. Carry hand luggage with a sum of length, width and height exceeding 180 centimeters and objects longer than 190 centimeters (except for skis in a bag).

6.4.12. Stand on running boards and other inappropriate elements of the body of urban public land transport vehicles (trams, trolleybuses and buses) while the vehicle is in motion.

6.4.13. Stick any advertisements or handbills in passenger compartments of public urban transport vehicles (trams, trolleybuses and buses) without permission from the management of transport companies.

6.4.14. Take in hands any items and objects forgotten or left by unidentified persons. Upon having discovered any forgotten (left) objects, items, documents or things of value, or having felt an electric current impact, a burning smell, smoke or fire in a public urban transport vehicle (tram, trolleybus or bus), the passenger must promptly inform the driver accordingly.

6.4.15. Carry out professional photo or video shooting in passenger compartments of urban public transport vehicles (trams, trolleybuses and buses) without permission from the management of transport companies.

6.4.16. Violate the procedure for carrying domestic animals as set out in paragraphs 6.3.1.6 and 6.3.4 hereof.

7. Inspection of passengers’ compliance with these Rules, proof-of-payment inspections, and liability of passengers

7.1. Inspection of passengers’ compliance with these Rules and whether passengers of a tram, trolleybus or bus have tickets validated therein shall be carried out by fare inspectors throughout the operating hours of the public urban land transport services.

7.2. A person shall be deemed evading the fare if he/she:

7.2.1. Is discovered without a ticket on a vehicle, except for persons accompanying disabled persons with the first disability level and disabled children.

7.2.2. Has presented a ticket without a validation stamp.

7.2.3. Has presented a forged ticket.

7.2.4. Has presented an expired ticket.

7.2.5. Has presented an MSC, MRSC, UEC or a student discount ticket that does not belong to him/her or has expired.

7.2.6. Has presented a previously used ticket.

7.2.7. Has presented a ticket intended for a person entitled to fare privileges and has no document to confirm his/her entitlement to such privileges.

7.2.8. Has refused to present a ticket to confirm the payment of fare.

7.3. Proof-of-payment inspections with respect to the fare and hand luggage charges shall be carried out in passenger compartments of urban public land transport vehicles (trams, trolleybuses and buses).

7.3(1). If as a proof of payment a passenger presents to a fare inspector on the public urban land transport any ticket referred to sections 7.2.3, 7.2.4, 7.2.6 and 7.2.7 hereof, or a MSC or MRSC or a student discount ticket that does not belong to him/her or has expired, such document shall be withdrawn in accordance with the established procedure. The ticket (document) withdrawal shall be documented by a report issued in two copies, with one copy to be issued to the passenger presenting the ticket (document) and the other to be kept by the fare inspector.

7.4. Passengers shall be liable for damage caused to public urban transport vehicles (trams, trolleybuses and buses), any equipment thereon, and road facilities (tram rails, contact lines, etc.) in accordance with laws. The responsible person may also be claimed for damages as provided by law.

7.5. Failure to comply with these Rules will result in administrative liability under the laws of the Russian Federation and the City of Moscow. Payment of the fare and/or hand luggage charges as provided in paragraph 6.2.5 hereof or refusal to pay the same will not release the passenger from payment of fines for ticketless travel and/or carriage of unpaid luggage on public urban transport as established by the laws on administrative offenses of the City of Moscow. The authority to issue reports and process administrative offence cases under Articles 10.1 and 10.5 of the Law of the City of Moscow No. 45 dated November 21, 2007 “Code of Administrative Offences of the City of Moscow” is vested in inspectors of GKU “Organizator Perevozok”. 8. Duties of fare inspectors on public urban land transport

8.1. When working on a line, a fare inspector on public urban land transport shall hold an official identification card, produce it immediately upon request of a passenger and announce his/her last name.

8.2. When working on a line, fare inspectors on public urban land transport shall have the following rights and duties:

8.2.1. Monitor passengers’ compliance with these Rules, including, without limitation, that the fare and hand luggage charges are paid appropriately.

8.2.2. If any passengers are found to violate these Rules, take action with respect to violators as provided by the laws and paragraphs 6.2.5, 7.3(1) and 7.5 hereof to the extent of their authority.

8.3. Other rights and duties of the fare inspector shall be defined in his/her job description.
